This was an exceptionally heavy week for Indian fintech policy. Parliament passed two landmark bills redefining digital payments monetisation and banking evidence law. The RBI held its August MPC meeting, resumed urban cooperative bank licensing after two decades, and the Delhi High Court ordered the winding up of Paytm Payments Bank. Below are the five most consequential regulatory developments of the past seven days.


1. Parliament Ends the Zero-Fee UPI Era — MDR Returns for Large Merchants

The biggest fintech policy story of the year.

On August 6, the Lok Sabha passed the Taxation and Other Laws (Amendment) Bill, 2026, which amends Section 10A of the Payment and Settlement Systems Act, 2007. For the first time since January 2020 — when the government mandated zero Merchant Discount Rate (MDR) on all UPI and RuPay debit card transactions — merchant fees on UPI are now legally possible 12.

What the Bill Does

The amendment decouples payment charge exemptions from the Income Tax Act. Previously, Section 269SU mandated zero charges across all specified digital payment modes. The new framework grants the Central Government discretionary authority to selectively notify which electronic payment methods, merchant categories, or transaction thresholds will remain exempt 1.

Critically, the amendment does not impose fees immediately. It creates the legal framework for the government to reintroduce MDR through executive orders — ending the blanket prohibition that had structured every Indian fintech business model for six years.

Proposed Structure

Industry deliberations point to a tiered reintroduction:

  • Scope: Restricted to large enterprise merchants, primarily for transactions exceeding ₹2,000
  • Fee range: Government deliberations consider 5–7 basis points; market estimates suggest fees could reach 30–40 bps
  • Volume vs. value: Transactions above ₹2,000 account for ~40% of UPI volume but nearly 70% of total value 1

In July 2026 alone, UPI processed a record 23.66 billion transactions worth ₹29.88 lakh crore 3. The monetisation potential of the high-value segment alone is substantial.

The MSME Pushback

ASSOCHAM Secretary General Saurabh Sanyal flagged concerns immediately: any MDR on UPI payments above ₹2,000 could prove a setback for MSMEs, as additional transaction costs may increase their financial burden and discourage digital adoption 4.

What This Means

This is the most significant recalibration of India’s digital payments economics since UPI launched. Payment aggregators, PSPs, and acquiring banks finally have a credible path to direct revenue from UPI processing. For pure-play payment apps, this could be transformative. For fintechs embedded in credit ecosystems (Flipkart’s super.money), the impact is more nuanced — they earn through credit products regardless of payment-layer fees.

The devil is in implementation: threshold definitions, merchant categorisation, and the actual notified rates will determine winners and losers across the ecosystem.


2. RBI Holds Rates at 5.25% — Cautious Neutral Stance Amid Global Uncertainty

The RBI’s Monetary Policy Committee concluded its three-day August meeting on August 5, maintaining the benchmark repo rate at 5.25% for the fourth consecutive meeting 56.

  • Repo rate: Unchanged at 5.25%
  • Stance: Retained “neutral”
  • FY27 inflation forecast: Cut to 5%
  • Growth outlook: Downgraded — Governor Sanjay Malhotra noted that “growth, although resilient, is expected to be lower in this financial year” 7

The Rationale

The MPC’s caution is grounded in multiple headwinds: elevated global commodity prices driven by geopolitical tensions, El Nino risks to food inflation, and trade volatility. The central bank is clearly waiting for clearer data before considering any rate cuts, despite growth concerns 57.

Fintech Implications

A held rate means borrowing costs remain stable — neither pressuring loan growth through tighter credit nor stimulating it through cheaper funding. For digital lenders, this translates to a steady but unspectacular operating environment. The neutral stance also means the RBI isn’t signaling imminent liquidity easing, which keeps deposit competition fierce for digital banking players.


3. RBI Resumes Urban Cooperative Bank Licensing After Two Decades

In a move with profound implications for financial inclusion, Governor Malhotra announced that the RBI will issue draft guidelines for on-tap licensing of Urban Cooperative Banks (UCBs) — ending a freeze on new UCB licences that had lasted over 20 years 89.

Why It Matters

UCBs serve a critical niche: they are neighbourhood banks deeply embedded in local communities, particularly in semi-urban and tier-3/4 areas where large commercial banks have limited presence. The licensing freeze, imposed after a series of governance failures and scams (notably the PMC Bank collapse), effectively choked off expansion of this sector.

The New Framework

While detailed guidelines are yet to be published, the RBI has signalled:

  • Stringent eligibility norms for credit and governance
  • Focus on capital adequacy and risk management
  • Review of the lending rate framework for cooperative banks 8

This is a calibrated reopening — not a free-for-all. The RBI wants fresh entrants that are well-capitalised and governance-compliant, not repeat offenders of the cooperative banking sector’s historical weaknesses.

Consumer Angle

For consumers in underserved areas, more UCBs could mean better access to banking services, deposit products, and credit. But the RBI’s caution is warranted: cooperative bank failures have historically left depositors stranded. The success of this reopening hinges entirely on enforcement rigour.


4. Bankers’ Books Evidence Bill — Colonial-Era Law Finally Updated

On August 5, the Lok Sabha passed the Bankers’ Books Evidence Bill, 2026, replacing the Bankers’ Books Evidence Act, 1891 — a 135-year-old colonial-era law 1011.

What Changes

The new bill recognises the reality that banking records are no longer leather-bound ledgers. Key provisions:

  • Expanded definition: “Bankers’ books” now covers records maintained in physical, electronic, digital, virtual, and cloud-based formats, including disaster-recovery locations
  • Digital evidence: Electronic and digital records are expressly admissible, valid, and legally enforceable as evidence
  • Certification framework: Separate certification formats for physical and electronic records, with nominated bank officers authorised to certify 12

The Good

This was overdue. India’s banking system is overwhelmingly digital — 99.8% of retail transaction volumes are digital 10. Having an evidence law rooted in 1891, when records were physical ledgers, was anachronistic and created friction in legal proceedings involving digital banking disputes.

The Concerns

Moneylife raised a critical point: the Bill allows police to access bank records without a court order in certain circumstances, and the broad certification requirements could expose banks to liability over system integrity attestations 12. These are valid concerns that need scrutiny as the Bill moves to the Rajya Sabha.


5. Paytm Payments Bank Wound Up — Final Chapter in RBI’s Regulatory Crackdown

The Delhi High Court ordered the winding up of Paytm Payments Bank Limited (PPBL) through orders dated July 8 and July 22, 2026, following the RBI’s application under the Banking Regulation Act, 1949 1314.

  • Official Liquidator: Girikumar M Nair, former CGM of SBI, appointed to oversee the winding up
  • Trigger: RBI cancelled PPBL’s banking licence in April 2026 over persistent non-compliance with regulatory norms

What This Means for Paytm

This is the final act of a drama that began with the RBI’s clampdown in January 2024. One97 Communications (Paytm’s parent) had already migrated all backend payment and banking operations to private-sector banks (Axis, Yes, HDFC). According to Moneycontrol, Paytm’s payment processing charges have actually declined by ~35% since shifting away from PPBL to private banks 15.

PB Fintech Expands Under SEBI

Meanwhile, PB Fintech (Policybazaar’s parent) used its Q1 FY27 earnings call to outline its regulatory expansion:

  • Stock broking licence: Received from SEBI, adding to its existing payment aggregator licence
  • Online Bond Platform: SEBI approval to operate as an Online Bond Platform Provider — users can now invest in corporate bonds, government securities, and FDs
  • PB Health: Targeting ₹500 crore in Annual Recurring Revenue by March 2027 16

On the insurance regulation front, PB Fintech’s Group CEO pushed back against IRDAI’s reported consideration of an effort-based commission model, calling it “not feasible” and pointing to a legal contradiction in the proposal 16.
